The Emergency Medical Treatment and Labor Act (EMTALA) still may apply once a patient's initial emergency medical condition has been resolved. Another emergency that arises while the patient still is in your ED could trigger another EMTALA obligation. Emergency physicians are not necessarily obligated to conduct another exam every time the patient complains of something new. Medical judgment should determine when the patient's complaint requires another examination.
