The growing problem of discrimination against physicians seeking hospital staff privileges may be met by various tort and contract actions against hospitals and medical staff members. In many jurisdictions, the obstacles presented by common-law and statutory immunities and the unavailability of judicial review for actions involving private hospitals pose formidable obstacles. However, the current trend in the courts would seem to be toward actionability.
