Review of the Hearst trial transcript reveals that the subpoena Dr. Joel Fort's residency files met with very little effective resistance on the part of the hospital that had trained him. There are few legal mechanisms to stop such a subpoena. The only truly effective solution may be the abstraction and destruction of residency files once the residency has been successfully completed.
