This article reviews the manner in which a court determines whether a medical practitioner has acted in accordance with the appropriate standard of care and considers, in particular, the reliability of the expert evidence which the court relies upon in this regard. The article suggests some options for reform of the way in which expert evidence is being presented to courts.
