The Racketeer Influenced and Corrupt Organizations Act (RICO) was originally enacted to fight organized crime. Recently, however, the United States Supreme Court ruled that health insurers could be sued for fraud under the Act. This article examines the broad reach of RICO, and its potential application to MCOs in light of the Supreme Court's actions and several new lawsuits.
