Two recent decisions by the Supreme Court of Canada have altered some aspects of the law of consent and clarified others. The decisions have in part cut down the latitude which a physician has in deciding what to tell his patients. The courts have opted for an objective approach which requires the physician to present to the patient all material facts relating to the patient's situation so that the patient may choose what if any investigation or treatment he will have.
加拿大最高法院最近作出的两项裁决改变了同意法的某些方面,并澄清了其他方面。这些裁决在一定程度上缩减了医生在决定告知患者何种信息时的自由裁量权。法院选择了一种客观的方法,要求医生向患者陈述与患者病情相关的所有重要事实,以便患者能够选择接受何种检查或治疗(如有)。
