An HIV-positive Ghanaian woman who applied for asylum in the United Kingdom has been granted permission to remain on the grounds that returning her to Ghana would violate the rights of her unborn child pursuant to Article 3 of the European Convention on Human Rights. Article 3 states that "no one shall be subjected to torture or to inhuman or degrading treatment or punishment."
