The complexity of the discussion about the advance directive requires not only juridical, but most importantly ethical considerations. These are advanced in three steps in this article: a reflection about the changed perception of death and dying today after the anthropological and technological turn; a new understanding of the notion of autonomy as contextual, historical and communicative; autonomy as a process of learning. The discussion about the advance directive becomes thus a space for thinking about new forms of integrated care and a dignified death.
关于预嘱的讨论复杂性不仅需要法律考量,更重要的是伦理考量。本文分三步深入探讨:一是在经历人类学和技术转向后,反思当今对死亡和临终的认知变化;二是对自主性概念形成一种新的理解,即自主性是情境性、历史性和交际性的;三是将自主性视为一个学习过程。因此,关于预嘱的讨论成为了一个思考新型综合照护形式和尊严死亡的空间。
