Abstract

Distinguishing section 3 Juvenile Court Act (JGG) from sections 20, 21 Criminal Code (StGB) can cause some serious problems from time to time, the consequences for the investigated juveniles are then often also serious. The basis for the legal decisions are shown as well as the commentaries written on them which are partly contradicting. With the aid of five examples out of the practice of a child psychiatric expert decision criteria as a guide for an appropriate judgement are developed and discussed.

区分《少年法庭法》（JGG）第3条与《刑法典》（StGB）第20、21条有时会引发一些严重问题，对被调查的青少年产生的后果往往也很严重。文中展示了法律裁决的依据以及针对这些依据所撰写的评注，而这些评注部分相互矛盾。借助儿童精神病专家实践中的五个实例，制定并讨论了作为适当判断指南的决策标准。
